The appellants seek pre arrest bail in connection with Paliganj P.S.Case No.177 of 2016 registered for offences punishable under Sections 341, 323, 325, 353, 379/34 of the Indian Penal Code and section 3(i)(x) of SC/ST (Prevention of Atrocities) Act.

Allegation against the appellants is of abusing him by taking caste name and also of assaulting.

Submission of the learned counsel for the appellants is that no injury is available on the record and as a matter of fact earlier he had lodged a complaint against the informant, which will appear from Annexure 2, 3, and 4, as such this false and concocted case has been lodged making allegation under SC/ST

Patna High Court CR. APP (SJ) No.2273 of 2017 (3) dt.01-09-2017 2/2 (Prevention of Atrocities Act) for making the case serious. Heard learned Special P.P. also, who has opposed the prayer for bail on the ground of maintainability Having considered both sides and in view of the submission, let the appellants surrender and make for regular bail before the court of learned Special Judge, who will consider the prayer for bail on the basis of submissions as stated above and will dispose of the prayer for bail of the appellants, if possible on the same day.
