Petitioner apprehends his arrest in Nathnagar P.S. Case No.154 of 2017 instituted for the offence under Section(s) 376/34 Indian Penal Code and Section 4 of the POCSO Act. Prayer of the petitioner for grant of anticipatory bail was rejected by this Court by order dated 17.10.2017 passed in Cr. Misc. No.47940 of 2017. Petitioner was directed to surrender in the Court below and seek regular bail. It appears that order dated 17.10.2017 was passed on merit after discussing all the materials of the case. Therefore, this Court is not inclined to entertain this second anticipatory bail application.

Patna High Court Cr.Misc. No.67122 of 2018(2) dt.28-11-2018 2/2 Prayer of the petitioner for grant of anticipatory bail is, again, rejected.

Petitioner is directed to surrender before the Court below and make prayer for regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order.
