The petitioner seeks bail in a case registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and under section 25 (1-b) a, 26 & 35 of the Arms Act.

It is submitted that the name of the petitioner has appeared in the confessional statement of co-accused Ranjan Kumar and a mobile phone and one live cartridge of 8 M .M. were recovered from his possession. It has been further submitted that only mobile has been recovered from the possession of the petitioner but live cartridges has not been recovered from his

Patna High Court Cr.Misc. No.39648 of 2014 (3) dt.06-02-2015 2/2 possession. The petitioner has been in custody since 29.06.2014. Considering the facts and circumstances, the above named petitioner, Avinash Yadav @ Avinash Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No.351/2014 corresponding to G. R. No. 1392/2014 with following conditions :- I) One of the bailors will be the close relative of the petitioner.

II) The petitioner will not indulge in similar or in any other offence.

III) The petitioner will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
