JUSTICE SANJAY KUMAR ORAL ORDER 17-08-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Sangrampur P.S. Case No. 37 of 2017 registered for the offences punishable under Sections 147, 149, 323, 324, 325, 354, 379, ,307, 447, 427, 504 and 506 of the IPC.

The informant has alleged that on 16.03.2017 these petitioners armed with deadly weapon came and started abusing the informant on the order of petitioner no. 3 and snatched the gold chain from the wife of the informant. The brother of the informant was also assaulted when he came for his rescue. Learned counsel for the petitioners submits that these petitioners are cousin of the informant. Patna High Court Cr.Misc. No.38153 of 2017 (2) dt.17-08-2017 2/2 omnibus against them. The full brother of petitioner no. 1 has eight sons and one daughter. The brother of these petitioners is to marry his daughter for which he was negotiating to transfer some of his land which was being opposed by some of his sons. The allegation of assault is against other accused persons. No offence under Section 307 of the IPC is made out against these petitioners. Learned Additional Public Prosecutor opposed the aforesaid submission.

Considering the nature of allegation facts and circumstances, as stated above, this application for anticipatory bail is allowed.

Let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-14, East Champaran at Motihari in connection with Sangrampur P.S.
