The petitioner seeks bail in connection with Patahi P.S. Case No.113 of 2022 registered for the offence under Section 394 of the Indian Penal Code.

The petitioner and three others are said to have looted Rs.2,75,000/- cash, watch, helmet and motorcycle from the informant and also assaulted him.

It has been submitted by learned counsel for the petitioner that the F.I.R. is against unknown persons and the petitioner has not been put on T.I. parade. He further submits that the petitioner is in custody since 13.03.2023. 5.

Learned counsel for the petitioner also submits that petitioner is ready to pay a part of the looted amount to compensate the informant without accepting the allegation.

Considering the fact that the petitioner has not been put on T.I. parade and there is no recovery from him, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Patahi P.S. Case No.113 of 2022. 8.

This is also subject to the condition that the petitioner shall produce a demand draft of Rs.70,000/- issued in favour of the informant at the time of furnishing bail bonds. The Court below shall give the said demand draft to the informant after proper verification and thereafter accept the bail bonds of the petitioner.

This is subject to the condition that petitioner shall mark his attendance in Kundwachainpur Police Station, District- East Champaran, Motihari, on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
