JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Town Hajipur P.S. Case No. 802 of 2014 for the offences instituted under Sections 420, 467, 120(B) and 504/34 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the father of the complainant has no any son and the complainant is only two sisters. After the death of the father of the complainant, the complainant Urmila Devi and her sister Meera Devi came in possession over the land of their father. Patna High Court Cr.Misc. No.29799 of 2015 (2) dt.29-07-2015 2/3 accused Arun Kumar Singh alongwith other accused persons under conspiracy fraudulently sold the aforesaid land of the complainant. It is further alleged that the informant obtained copy of the sale-deed from the registry office and learnt that the accused person with intention to cheat got prepared forged paper and on 18.10.13 executed the sale-deed in favour of petitioner Raj Kumar Bharatiya, Dinesh Kumar Kushwaha and Anil Choudhary made their signature as witnesses on the alleged sale-deed. It is further alleged that in the alleged sale-deed the father of the complainant has been shown issueless.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the allegation relates to civil dispute between the parties. Other co-accused has been granted bail vide Cr. Misc. No. 16665/2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Town Hajipur P.S. Case No. 802/2014 on furnishing bail bond of Rs. 10,000/-(Ten
Patna High Court Cr.Misc. No.29799 of 2015 (2) dt.29-07-2015 3/3 Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
