JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Maker P.S. Case No. 182 of 2017, dated 23.11.2017, instituted for the offences under Sections 420 and 409 of the Indian Penal Code.
The petitioner, who allegedly was working as a Junior Engineer at Maker in the district of Saran in the year 2002-2003, is stated to have filled up the measurement
Patna High Court Cr.Misc. No.69235 of 2018(2) dt.18-12-2018 2/3 book with respect to the work of construction of a water shade under Scheme No. 8 of 2002-2003, without the work having been completed, thus putting the Government to a loss of around 88,500/- rupees in cash and 23 quintals of rice.
The learned counsel for the petitioner has submitted that for an act which was committed in the year 2002-2003, the F.I.R. has been lodged in the year 2017. Apart from this, it has also been submitted that the measurement book was not filled up by him rather by some other Junior Engineer after about six months of his exit from that place of posting.
Considering the vague nature of allegation and the facts stated above, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional
