JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-03-2018 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing of the order dated 29.03.2017 passed by the learned Railway Judicial Magistrate, Samastipur in R.P.F.(S.P.J.) P.S. Case No.03 of 2015 by which cognizance has been taken under Section 3 of the Railway Property (Unlawful Possession) Act against the petitioner.

After some arguments, learned counsel for the petitioner

Patna High Court Cr.Misc. No.38222 of 2017 (2) dt.14-03-2018 2/2 seeks leave to withdraw the present application in order to raise all the points available to the petitioner at the time of framing of charge.
