JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 364, 376, 511, 120(B) and 34 of the Indian Penal Code. The informant's daughter is alleged to have been kidnapped in a Maruti vehicle by three miscreants. The petitioner was not named in the first information report. The said vehicle belonged to one Santosh Kumar Singh.
Learned counsel for the petitioner submits that victim, Sita Kumari, has given her statement under section 164 of the Cr.P.C. wherein she has not leveled any allegation against the
Patna High Court Cr.Misc. No.42487 of 2014 (3) dt.16-04-2015 2/2 petitioner. He further submits that petitioner's name has cropped up only on the basis of statement of father of Santosh Kumar Singh, the owner of the vehicle. He submits that there is no material, over and above, the said statement of father of Santosh Kumar Singh against the petitioner.
In view of submission, as above, and in view of statement made in paragraph 3 of the application that petitioner has no criminal antecedent, the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be released on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Balendra Shukla, learned Judicial Magistrate, Ist class, Sasaram at Rohtas in Kargahar PS case No. 33/2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
