2. The petitioner seek regular bail in connection with Nauhatta P.S. Case No. 101 of 2025 registered for the offences punishable under Sections 191(2), 190, 103(1) of the Bhartiya Nyay Sanhita, 2023 and under Section 3⁄4 Bihar Witch (Daain) Practices Act, 1999.

3. As per the First Information Report, the informant alleged that the petitioner along with other accused persons killed his wife, namely, Kismi Devi by throttling.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. There is case and counter case between the parties. From perusal of the FIR, it appears that

No.60892 of 2025(2) dt.09-09-2025 2/2 although the petitioner is named in the FIR but there is no specific allegation of assault or overt act against him, rather the allegation levelled against all the accused persons including the petitioner is general and omnibus. The petitioner is in custody since 12.04.2025.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances, there is no specific allegation of assault or overt act against the petitioner, the petitioner has clean antecedent and there is case and counter case between the parties, this application is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri, Rohtas in connection with Nauhatta P.S. Case No. 101 of 2025.
