The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 487 of 2021, registered for the offence under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

As per prosecution case, 74.745 litres of illicit liquor has been recovered from the tempo.

It is submitted on behalf of the petitioner that name of the petitioner has transpired during course of investigation, in the confessional statement of co-accused, Md. Seraz. Petitioner is neither owner nor driver of the tempo and no recovery has been made from the conscious possessions of the petitioner. Petitioner claims clean

Considering the period of custody and clean antecedent of the petitioner, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge 2nd-cum-Special Judge, Excise Act, Gopalganj, in connection with Kuchaikote P.S. Case No. 487 of 2021.
