JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Rafiganj P.S. Case no. 119 of 2017, registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code. The accusation is that in the evening of 18.07.2017, Suman Kumari, niece of the informant, threw a glass of water in the lane, due to that reason his Gotiya Shankar Sharma, Petitioner No.2 Raju Sharma, Ranjan Sharma and petitioner No.1 Gita Devi came at the door of the informant and started abusing him. At that time, Shankar Sharma gave rod blow at the head of informant. When Manhngu Sharma, brother and Sushila Devi, sister-in-law of the informant, came to rescue him then Raju Sharma caught hold them and Ranjan Sharma caused injury to them by means of lathi.

No.47580 of 2017 (2) dt.10-10-2017 2/2 Learned counsel for the petitioner submits that petitioners and informant are Goita and due to some dispute hot talks were exchanged in which informant and his family members sustained slight injury simple in nature. Moreover, the allegation of causing assault to the informant his brother and sister-in-law are against the Shankar Sharma and Ranjan Sharma and not against the petitioners. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 119 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
