The petitioner apprehends his arrest in connection with Bhabhua P.S. Case No. 342 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about selling the illicit liquor by Pappu Bind @ Pappu Rangila (petitioner) in village Dhadhiyan keeping the same near the pond, the informant along with other police personnel reached there and searched nearby the house of the petitioner. In that course, ten bottles each containing 180 ml Romeo Vickey recovered nearby the house of the petitioner. On query, informant came to know that petitioner used to sell the

Learned counsel for the petitioner submits that it would appear from the F.I.R. that ten bottles each containing 180 ml Romeo Viskey are said to be recovered nearby the house of the petitioner not from the house of the petitioner. Further submission is that while it is detailed that villagers have detailed about selling the illicit liquor by the petitioner but the name of the villagers have not been disclosed in the FIR and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Kaimua at Bhabua, in connection with Bhabhua P.S. Case No. 342 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
