2. The petitioner seeks bail in connection with Khaira P.S. Case No. 52 of 2025 registered for the offence under Sections 126(2), 115(2), 109, 352, 351(2) of the BNS.

3. As per the prosecution case, the petitioner and others are said to have assaulted the victim.

4. The petitioner is in custody since 24.04.2025.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner has only caught hold of the victim and he has not assaulted the victim.

6. Learned counsel for the informant has vehemently opposed the application of the petitioner for grant of

Patna High Court CR. MISC. No.63249 of 2025(2) dt.17-09-2025 2/2 bail and has prayed for listing of this case with a case arising out of the same police station case number in which case diary has been called by a Co-ordinate Bench.

7. Considering the facts of the case and the nature of allegation levelled against the petitioner, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chhapra/concerned Court below in connection with Khaira P.S. Case No. 52 of 2025.
