JUSTICE SANJAY PRIYA ORAL ORDER 07-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Katoria P.S. Case No. 113 of 2017 instituted for the offence under Sections-420, 409, 467 of the Indian Penal Code.
It is alleged in the written report that the petitioner was incharge, Headmaster of Pronnat Madhya Vidyalaya, Sijuwas and Rs, 658,000/- was transferred in the account of Vidyalaya Shikcha Samiti for construction of three class room in the year, 2008-09 by Bihar Siksha Pariyojana Karyalaya Banka in two installments and agreement was prepared but according to measurement book, only work of Rs. 2.03 lacs was done.
A report was called for by this court from the District Magistrate, Banka with regard to current status of construction work of the aforesaid school which has been received.
Patna High Court Cr.Misc. No.46027 of 2017 (4) dt.07-12-2017 2/2 In the report, it has been mentioned that the construction of the school is incomplete and work for Rs. 1,74,255/- is still to be done.
It is mentioned in the report that money was transferred in the year, 2012 itself and still work is incomplete. Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
