The petitioner seeks pre arrest bail in Fulkaha P.S.Case No.116/16 for the offence under Sections 452 and 380 of the I.P.C.

Accusation is that on 5.11.2016 at about 3.30 P.M. 7/8 miscreants entered into the courtyard of the informant, Mahesh Prasad Mehta and started to break the door through axe and when the informant and his family members raised alarm then they started to move from there taking pletina Motor cycle kept in courtyard. At that time the informant chased and at some distance identified the petitioner.

Learned counsel further submits that the petitioner and the informant are co-villager and due to village politics he has

Patna High Court Cr.Misc. No.13571 of 2017 (6) dt.24-11-2917 2/2 implicated this petitioner. The F.I.R. has been lodged after seven days of the occurrence. There is general and omnibus allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Ashish Ranjan, J.M.1st Class, Araria, in Fulkaha P.S. Case No.116/16 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
