23-05-2016 The petitioner apprehends his arrest in relation to Laxmipur P.S. Case No. 10 of 2016 (G.R. No. 82/16) registered under Sections 341, 323, 325, 324, 337, 338, 307, 379, 504, 506 and 34 of the Indian Penal Code.
The prosecution case is that the petitioner along with others came and assaulted the son of the informant with iron Khanti and iron rod. The son of the informant Santosh Rabidas who suffered head injury. Sri Akhileshwar Prasad Singh, learned senior counsel in support of the application, submits that the informant and the petitioner are own brothers and it was a fight within the family. There has been a counter case in which it has been alleged that the informant of the present case assaulted his own mother.

No.21857 of 2016 (2) dt.23-05-2016 2 / 2 Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Shankar Das, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, Judicial Magistrate, 1st Class, Jamui, in connection with Laxmipur P.S. Case No. 10 of 2016 (G.R. No. 82/16), subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
