JUSTICE SHIVAJI PANDEY ORAL ORDER 10-09-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant through Video Conferencing. In this case, the petitioner is seeking anticipatory bail in connection with Gogri P.S. Case No. 197 of 2019 registered for offence punishable under sections 498(A)/341/323/354(b)/504/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

The marriage of the informant was solemnized with the petitioner on 26.02.2019 in which a handsome amount was paid to the petitioner and his family members, but the marriage could not run smoothly. Both sides have tried to settle the

Patna High Court CR. MISC. No.71673 of 2019(8) dt.10-09-2020 2/3 dispute, but the same could not be materialized. In such view of the matter, this Court is referring the matter to the concerned court below to make endeavour for settling the dispute between the parties.

For the present, the petitioner is granted provisional bail and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be released on provisional bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 197 of 2019, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
