JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1537 of 2013 for the offences instituted under Sections 420, 406 and 506 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

Prosecution case, in short, is that complainant has executed a power of attorney on 28.06.2010 in favour of the petitioner to sell the particular land and to hand over the amount to his wife. Petitioner sold the land to different persons against the total amount of Rs.12,15,000/- and on inquiry petitioner always said on phone that land has not been sold. On 25.01.2013, when complainant came from abroad and came to know that his land has been sold and amount has been grabbed.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.30088 of 2015 (2) dt.29-07-2015 2/2 petitioner has got no criminal antecedent. From perusal of the complaint it appears that it is civil dispute between the parties. On behalf of the State it has been submitted that the petitioner is named in the complaint.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1537 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Sunil Dutt, Judicial Magistrate, Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
