This application for anticipatory bail arises out of Nawada Nagar P.S. Case No. 288 of 2018, disclosing offences under Sections 147, 148, 149, 447, 448, 341, 323, 427, 307, 379 and 504 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioner, submits that there is the allegation against the petitioner of causing assault by shod. Referring to the injury report, he contends that no injury caused by sharp-cutting weapon, has been found. It has also submitted that similarly circumstanced co-accused persons, namely, Naresh Yadav and Sobha Devi, have been granted anticipatory bail vide order dated 08.10.2018 passed in Criminal Misc. No. 55871 of 2018

Patna High Court Cr.Misc. No.73145 of 2018(2) dt.19-12-2018 2/2 and order dated 27.07.2018 passed in Criminal Misc. No. 44274 of 2018.

Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nawada in Nawada Nagar P.S. Case No. 288 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
