2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Phulwaria P.S. Case No. 138 of 2023.

3. As per prosecution case, some unknown miscreants have stolen the motorcycle of the informant.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR rather the same has been lodged against unknown persons. No T.I.P. has been done. He further submitted that alleged motorcycle

Patna High Court CR. MISC. No.68176 of 2024(2) dt.01-10-2024 2/2 which is said to be stolen was recovered from a place which is accessible to public at large. No incriminating/stolen article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.10.2023.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Begusarai in connection with Phulwaria P.S. Case No. 138 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
