JUSTICE ARUN KUMAR JHA ORAL ORDER 12-09-2025 Learned senior counsel appearing on behalf of opposite party nos. 5 and 6 has produced copy of order dated 22.08.2025, whereby the injunction petition filed by the opposite party nos. 5 and 6 has been disposed of.

2. Perusal of record shows the opposite party nos. 5 and 6 approached this Court by filing Civil Misc. No. 93 of 2024 seeking direction to the learned court of Sub-Judge 1s, Gaya to hear and pass appropriate orders on the application preferred by the plaintiffs-petitioners under Order XXXIX Rule 1 & 2 in Title Suit No. 807 of 2023, for directing the defendants to maintain status quo with respect to the suit property and pass appropriate order of an interim injunction restraining the defendants from interfering in peaceful possession of the plaintiffs over the suit property.

3. This Court, vide order dated 15.04.2024 passed in Civil Misc. No. 93 of 2024, directed the learned trial court to take further steps for early disposal of the injunction petition and try to dispose of the same within three months from the date of receipt/production of a copy of the order. While parting with the order, this Court directed that in the interest of justice, till the final orders were passed on the injunction application, the petitioners and respondents 1st set therein were directed to maintain status quo with regard to the suit property.

4. The petitioners/defendants have filed the present petition for initiation of an appropriate contempt proceeding against opposite party 1st set and opposite party 2nd set claiming that both of them have not complied the order dated 15.04.2024 passed by this Court in Civil Misc. No. 93 of 2024.

5. Show cause was filed by opposite party nos. 5 and 6/opposite party 2nd set denying the contention of the petitioners about violation of status quo order. Learned senior counsel further submits that the O.P. Nos. 5 and 6 have maintained the status quo with regard to the suit property. Moreover, the O.P. Nos. 5 and 6 approached this Court for direction to the learned trial court to dispose of their injunction application and the said application has been dismissed vide

4/4 order dated 22.08.2025. Therefore, nothing survives for consideration.

6. Considering the disposal of the injunction application filed by the opposite party nos. 5 and 6, hence, nothing remains in the matter and therefore, the present petition stands disposed of as such.
