The petitioners apprehend their arrest in connection with Naurangiya P.S. Case No. 27 of 2016 registered for the offence under Sections-302, 201, 120(B)/34 of the Indian Penal Code. It has been submitted that there is no specific allegation of overt act against the petitioners and they have falsely been implicated in the case on the basis of mere suspicion. It has further been submitted that co-accused persons with similar allegation have already been granted anticipatory bail by a coordinate bench of this court vide order dated 02-03-2017 passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.38079 of 2017 (2) dt.16-08-2017 1630 of 2017.
In the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the petitioners named above in the event of their arrest/surrender within six weeks from today in the court below shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in Naurangiya P.S. Case No. 27 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, West Champaran subject to conditions as laid down u/S 438(2) of the Cr.P.C. (Sanjay Kumar, J) A.K.V./- U T
