The petitioner seeks bail in Mohania P.S. Case No. 87 of 2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The brother of the deceased alleged that he heard that his brother Rajendra Prasad Yadav was being assaulted by Janardan Singh and his man. The people of the vicinity apprehended Janardan Singh on the spot. The deceased was taken to the hospital where the doctor declared him dead.

It is submitted that the petitioner is not named in the FIR. There is no material to show the involvement of the petitioner. The petitioner was not apprehended on the spot. Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.30475 of 2015 (2) dt.13-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case No. 87 of 2015.
