Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Rail/ Bachhwara P.S. Case No. 20 of 2022 lodged under Sections 147, 148, 149, 341, 342, 332, 333, 337, 338, 307, 427, 436, 353, 186, 187, 188, 189, 379, 380, 382, 504, 506 and 323 of the I.P.C., Sections 146, 150, 151 and 174 of the Railway Act and Sections 3/4 of Damage to Public Property Act. Learned counsel for the petitioner submits that the present case has been filed against 250-300 unknown persons. He further submits that nothing incriminating was recovered

Patna High Court CR. MISC. No.61395 of 2022(2) dt.22-12-2022 2/3 from the possession of petitioner, nor he was put on TIP. He also submits that in different paragraphs of the case diary no one has taken name of petitioner but the counsel submits that name of petitioner has been figured in this case at the instance of Police since there are 4 criminal cases pending against him and he is on bail in all 4 cases. Learned counsel further submits that it is the case relating to opposing the policy of Government i.e. Agniveer Scheme and petitioner is victim. He also submits that petitioner is in custody since 02.08.2022 and charge sheet has already been filed in this case. Learned counsel further submit that in other matters relating to Agniveer of other different districts Co-ordinate Bench of this Court as well as this Court has granted bail to the named accused persons . Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned R.J.M. Barauni in connection with Rail Bachhwara P.S. Case No. 20 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with

A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall be resulted into cancellation of his bail bond.

B. One of the bailors shall be close relative who shall file an affidavit before the court about his relationship with the petitioner.

C. The petitioner shall file an affidavit at the time of furnishing of bail bond that he shall not involve in such criminal activity during the continuance of present bail bond, violation of this condition shall be resulted into cancellation of his present bail bond.

With this observation, the bail application stands allowed.
