The petitioner, invoking writ jurisdiction under Article 226 of the Constitution of India, has prayed for a direction to include the name of the petitioner's mill in the final seniority list.

It has been stated on oath by respondents that at the time of physical verification, the mill of the petitioner was not found operational. It has also been indicated that for the last seven years, it was neither operational nor during the final hearing, any supportive documents were produced from the side of the petitioner, though; his representation was present. The petitioner's

Patna High Court CWJC No.1256 of 2014 (2) dt.06-08-2015 2/2 mill has not been included in the final list. Learned State counsel submits that the final list, prepared by the department, has already been submitted before the Supreme Court in a pending proceeding.

Keeping in view the fact that the matter is sub-judice before the Apex Court, it would not be advisable for this Court to pass any positive order in the writ petition. The writ petition stands disposed of.

If so advised, the petitioner may avail appropriate remedy.
