The petitioner apprehends his arrest in a case under Sections 409, 420 & 34 of the Indian Penal Code. The petitioner was In-charge Headmaster of Upgraded Middle School, Khiridih. It is alleged that the petitioner and the Secretary of the aforesaid school withdrew Rs. 3,00,000/- for construction of school building but the same was not constructed. It has been stated that the petitioner retired from service in the year 2014. The petitioner has completed the work as it appears from letter no. 752 dated 22.05.2015 (Annexure 2 series) that the District Programme Officer and Junior Engineer have given No Objection Certificate for completion of the school building.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.29051 of 2015 (2) dt.24-07-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Mishra, Judicial Magistrate, 1st Class, Gopalganj in Bijaipur P.S. Case No. 149/2014 (G.R. No. 3261/2014) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
