The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

As per prosecution case, informant alleged that on 16.01.2021 her daughter, aged about 15 years, had gone to attend coaching classes and did not return. After search, the informant got information that the victim has been kidnapped for the purpose of marriage by petitioner along with co-accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

The statement of the victim recorded under Section 164 of Cr.P.C, which is annexed as Annexure-2, wherein, she stated that she went with this petitioner with her own sweet will thereafter, they solemnized marriage in a nearby temple. It is further submitted that the victim girl is aged about 17 to 19 years old. Moreover, petitioner is languishing in judicial custody since 12.04.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bettiah (T) Kalibagh P.S. Case No. 44 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran.
