JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-08-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 304 (B), 120 (B) and 201/34 of the I.P.C.

The daughter of the informant, namely, Pinki Devi was married with the petitioner on 22.05.2013 and allegedly the petitioner and others started demanding one golden chain and shebuffalo by way of dowry and due to non fulfillment she was tortured and done to death and her dead body was also cremated. Submission is of false implication. Wife of the petitioner died due to breaking of stitch as she was operated earlier

Patna High Court Cr.Misc. No.35345 of 2015 (2) dt.27-08-2015 2/2 for acute pain in her abdomen. Other co-accused have been allowed pre-arrest bail and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. seriously opposes by submitting that the petitioner is the husband and his wife died unnatural death within seven years of her marriage and further there is allegation of demand of dowry. In the facts and circumstances as stated above, considering the allegation attributed against the petitioner and further that he is the husband, this Court is not inclined to grant privilege of pre-arrest bail to the petitioner and as such his such prayer stands rejected in connection with Kutumba P.S. Case No. 48 of 2014 pending in the court of C.J.M. Aurangabad. (Jitendra Mohan Sharma, J) Abhay/- U T
