Petitioners apprehend arrest in connection with Mahila (Dist.Sheohar) P.S. Case No. 33 of 2018 registered for the offences under Sections 323, 341, 376(2)(i), 504, 506 of IPC and Section 4 of POCSO Act.
The allegation as per F.I.R. is that one Dilip Kumar committed rape upon the minor daughter of informant. The said Dilip Kumar giving false assurance of marriage continued rape for about eight months. On account of which, she conceived and became pregnant.
It has been submitted that the allegation of rape is
Patna High Court Cr.Misc. No.74586 of 2018(2) dt.17-12-2018 2/2 specific against Dilip Kumar. These petitioners are father and other family members of Dilip Kumar, who allegedly abused and threatened the informant to face dire consequences when she went at the place of petitioners to make complaint. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheohar in connection with Mahila (Dist.Sheohar) P.S. Case No. 33 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
