The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other co-accused killed the sister of informant and tried to disappear the dead body.

It is submitted on behalf of the petitioner that thrust of accusation is against husband of the deceased who is already in custody. Informant is not eye-witness of the occurrence. This petitioner is father-in-law of the deceased and there is general and omnibus allegation. The police after investigation

Patna High Court CR. MISC. No.65509 of 2022(3) dt.05-05-2023 2/2 submitted final form bearing Final Form No. 224 dated 20.11.2019, but differing with the same learned court below took cognizance against petitioner under Section 302 IPC. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VIII, Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 235 of 2019 corresponding to Sessions Trial No. 489 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
