JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Akbarpur P.S. Case No. 39 of 2017 registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsels appearing for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the alleged recovered Mahua wine. Except suspicion there is nothing against this petitioner. Seizure list has not been prepared in accordance with law. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender

Patna High Court Cr.Misc. No.38588 of 2017(3) dt.01-09-2017 2/2 within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Nawadah in connection with Akbarpur P.S. Case No. 39 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
