The petitioners apprehend their arrest in Pupari P.S. Case No.198 of 2018 registered under Sections 366A and 34 of the Indian Penal Code.
The mother of the victim alleged that his daughter had gone to the house of his elder sister, Kajal Devi on the eve of marriage of Pinki Kumari, the sister-in-law of Kajal Devi. The informant further alleged that his daughter was kidnapped by her son-in-law and others.
The learned counsel for the petitioners submits that petitioner is mother and brother of son-in-law of the informant. Victim was recovered and she made her statement under Section 164 Cr.P.C.. She disclosed that her brother-in-law, Pappu Mallik
Patna High Court Cr.Misc. No.74815 of 2018(2) dt.20-12-2018 2/2 forcibly solemnised marriage with her.
Considering the fact that victim did not make any allegation against the petitioners who happens to be mother and brother of Pappu Mallik who is alleged to have forcibly married with the victim, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sitamarhi in connection with Pupari P.S. Case No.198 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
