The petitioner seeks bail in a case registered under Sections 399, 400, 402, 115 of the Indian Penal Code and Sections 25(1-AA), 26, 35 of the Arms Act.

Allegation is that one country made pistol along with one live cartridge is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.06.2019. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with one live cartridge is said to have been recovered. There is no compliance of Section 100 of Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. case No.760 of 2019.
