JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 Petitioner seeks bail in connection with Kasba P.S. Case No. 203 of 2017, registered for the offences punishable under Sections 363, 365, 302, 201 and 120B of IPC. Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 13.12.2018 passed in Criminal Misc. No.49379 of 2018.

Allegation against the petitioner is that on his confessional statement, the dead body was recovered. Submission of the learned counsel for the petitioner is that he is in custody for more than one and half years and up till now five witnesses have been examined and they have not supported the prosecution case.

Heard learned APP also.

Having heard both sides, in view view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.63849 of 2019(2) dt.16-10-2019 2/2 bail to the petitioner. However, the learned trial court is directed to expedite the trial and to conclude the trial within a period of six months, if the trial is not concluded within six months, the petitioner has to move before the court below for grant of bail on the basis of materials available on record and disposed of the application on the basis of the same.

With the above observations, this application is dismissed.
