The petitioner apprehends his arrest in Runnisaidpur P.S. Case No. 562/2015, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. The informant alleged that his sister was married to the petitioner six years ago. But after marriage the petitioner demanded Rs. 50,000/-. Due to non fulfillment of demand of dowry she was subjected to torture. His sister gave birth to two children. It is alleged that petitioner and others killed his sister on 22.10.2015 and hurriedly cremated her dead body. Learned counsel for the petitioner submits that during the course of investigation the witnesses have supported the case of prosecution. While the deceased was on fasting she fell down
Patna High Court Cr.Misc. No.21259 of 2016 (4) dt.26-07-2016 2/2 and died, the matter was informed to the informant and others, but the informant filed this false case for ulterior motive. It appears that the informant made very specific allegation that his sister was killed due to non-fulfillment of demand of dowry and her dead body was hurriedly cremated. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
