Petitioner apprehends arrest in connection with Ahiyapur P.S. Case No. 309 of 2018, Tr. No. 1661 of 2018 registered for the offence punishable under section 401 of the Indian Penal Code and section 25 (1-b)a/26/35 of the Arms Act. Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report. He has been implicated in this case on basis of the confessional statement of the co-accused. Nothing has been recovered from his possession. Except the aforesaid confessional statement, there is nothing against this petitioner. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case
Patna High Court Cr.Misc. No.73961 of 2018(2) dt.18-12-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge XIII-cum- Additional Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 309 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
