Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Hajipur Sadar P.S. Case No. 503 of 2022 disclosing offence punishable under Sections147, 148, 149, 341, 307, 427, 384, 386, 506, 120B of the Indian Penal Code, Section 27 of the Arms Act and Section 3, 4 of Explosive Substances Act.

Learned counsel for the petitioner has submitted that one of the co-accused Santosh Kumar has been allowed bail by a bench of this Court by order dated 07.02.2023 passed in Criminal Miscellaneous No. 59863 of 2022, against whom there is allegation in the FIR of having resorted to indiscriminate

Patna High Court CR. MISC. No.62696 of 2022(2) dt.04-03-2023 2/2 firing. Drawing this Court's attention to the allegations made in the FIR, learned counsel appearing on behalf of the petitioner has submitted that there is no allegation of any specific overt act against the petitioner.

Considering the submission that one of the co-accused namely, Santosh Kumar has been allowed regular bail by a bench of this Court vide order dated 07.02.2023 passed in Criminal Miscellaneous No. 59863 of 2022, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 503 of 2022.
