The petitioners seek bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act and Section 414/34 of the I.P.C.

120.960 liters of whisky has been recovered from a car and these two petitioners were occupant of the car. It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. Petitioners are neither owner nor driver of the said car and have no concern with the seized liquor. Petitioners claim clean antecedent and are in custody since 09.09.2021. Investigation is complete.

Patna High Court CR. MISC. No.479 of 2022(2) dt.11-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the fact that petitioner are ladies and have got clean antecedent as well as period of custody, their bail petition is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Bettiah, West Champaran in connection with Dhanha P.S.
