Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Simari P.S. Case No. 250 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 19.11.2021, charge-sheet has been submitted and has antecedent of three cases and allegation is of recovery of 231.60 litres of foreign liquor from a Tata Magic Van.
Learned counsel for the petitioner submits that the petitioner was not arrested at the spot and his name was disclosed by local people, who had inimical term with the
Patna High Court CR. MISC. No.403 of 2022(2) dt.02-03-2022 2/2 petitioner.
Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and was not arrested at the spot, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar in connection with Simari P.S. Case No. 250 of 2021.
