2. The petitioner seeks bail in connection with Excise Sadar P.S. Case No. 203 of 2025 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the prosecution case, the recovery is of 1086 liters of illicit liquor from a vehicle of which the petitioner was a driver.

4. The petitioner is in custody since 23.07.2025.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent as he was the driver of the vehicle and he was having no knowledge about what was being carried in the vehicle.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on

Patna High Court CR. MISC. No.61670 of 2025(3) dt.10-12-2025 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise-II, Samastipur/concerned Court below in connection with Sadar Excise P.S. Case No. 203 of 2025.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Badhara Police Station, District-Bhiwani, Haryana on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. Let a copy of this order be communicated to the Superintendent of Police, Bhiwani, Haryana through FAX for its compliance.
