2. Petitioners apprehend arrest in a case registered for
Patna High Court CR. MISC. No.66250 of 2023(2) dt.18-10-2023 2/3 the offence punishable under sections 366(A) and 34 of the Indian Penal Code.
3. As per the prosecution case, co-accused Rajesh Tiwary kidnapped the minor daughter of the informant, and these petitioners are alleged to have assisted the co-accused Rajesh Tiwary.
4. It is submitted on behalf of the petitioners that the victim, in her statement recorded under Section 164 Cr. P.C., has denied the prosecution case and stated that she, out of her own will, has solemnized marriage with co-accused Rajesh Tiwary.
5. Learned counsel for the State opposes the bail petition of the petitioners.
6. Considering the statement of the victim recorded under section 164 Cr. P . C and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Exclusive Special Judge , POCSO Act, Aurangabad in connection with Khudwan P.S. case No. 24 of 2021 , subject to the conditions laid down
