====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 147, 420, 341, 406, 379, 504 and 506/34 of Indian Penal Code.
It is alleged that complainant has paid all the due amount of the loan to the petitioner but when he demanded the receipt for the same, the accused persons including this petitioner told him that the receipt would be provided after full payment of loan and they also took away tractor of the informant.
Learned counsel appearing for the petitioner submits
Patna High Court CR. MISC. No.62023 of 2022(2) dt.01-05-2023 2/2 that the petitioner is innocent and has been made accused in this case only because he is Manager of the Agency. He next submits that no monetary role has been assigned to the petitioner and due to non-payment of loan amount taken from Sri Ram Finance, the agent of finance company has taken back the said tractor. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Complaint Case No. 56 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
