Petitioners is apprehending arrest in connection with Sahebganj P.S. Case No. 348/18 for the offence under sections 272 and 273 of the Indian Penal Code and 30(A)/41 of Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is owner of the vehicle which was allegedly used for carrying foreign liquor.

Learned counsel submits that vide order dated 5.11.2019 in Cr. W.J.C. No. 2645 of 2018 whereby this court has directed for release of the vehicle.

Considering the fact that petitioner has no criminal antecedent and he has been roped in the instant case on account

No.75089 of 2018(2) dt.18-12-2018 2/2 of the fact that vehicle was seized in connection with transportation of liquor, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge, Excise Act, Muzaffarpur, in connection with Sahebganj P.S. Case No. 348 of 2018 on the condition that in future if the vehicle is found used in such activities, liberty shall be available to the court below to cancel the bail bond of the petitioner including the condition as laid down under section 438(2) of the Cr.P.C.
