Petitioners seek bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft of motorcycle is against unknown. Name of the petitioners surfaced in the confessional statement of co-accused Vikash Kumar and from the house of one of the petitioners, motorcycle was recovered of which the petitioners had no paper.

Considering the entire facts, let the petitioners, above named, be released on bail, after framing of the charges against the petitioners, on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where

Patna High Court CR. MISC. No.60207 of 2019(2) dt.30-09-2019 2/2 the case is pending in connection with Khaira Police Station Case No. 197 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
