24-04-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Section 22, 23 of the PreConception & Pre-Natal Diagnostic Techniques Act, 1994. The allegation against this petitioner is that he is running Ultrasound machine without registration and doing sex determination illegally.

Petitioner denies the prosecution case and submits that entire prosecution case is false and concocted. No occurrence, as alleged, ever took place. The inspecting team, only on assumption, came to the conclusion that ultrasound machine was being used for sex determination. Neither any patient was present nor any examination was going on. No patient has lodged any complaint against this petitioner. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.64218 of 2022(8) dt.24-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Govt. Complaint Case No. 05 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
