The petitioner is seeking anticipatory bail in connection with Special Case No. 1064/2018 arising out of Sikty P.S. Case No. 151/2018 registered under Sections 147, 148, 341, 323, 324, 353, 379 of the Indian Penal Code and Sections 37, 45, 75(2) of Bihar Prohibition and Excise Act 2016, pending in the court of learned 2nd Additional Sessions cum Spl. Judge, Araria.

Even though it is the contention of learned counsel for the petitioner that he has been falsely implicated in the case but the allegations revealed from the record would show that the petitioner was apprehended by police and while he was being taken away some persons intervened and forcefully got the

In the given facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. If he surrenders and prays for regular bail within a period of four weeks the application shall be considered on its own merit without being prejudiced by the order of this court.
