This application, for grant of anticipatory bail, arises out of Sheikhpur Sarai Police Station Case No. 24 of 2017, disclosing offences under Sections 341, 323, 307, 504, 494/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. In fact, the petitioner happens to be husband of the petitioner and has never assaulted the informant. According to annexure-2, the injury sustained by the informant is simple in nature. Patna High Court Cr.Misc. No.34719 of 2017 (4) dt.12-10-2017 submitted that the petitioner along with co-accused, Gudiya Devi, who happens to be Sautan of the victim, having armed with sharp Hasuli assaulted the victim and try to cut her neck with intention to kill her resultantly the victim sustained injury on neck.

Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
