The petitioner seeks bail in connection with a case registered for the offence punishable u/s 304B, 201, 120B, 34 of the IPC.

As per the prosecution case, petitioner and other co-accused persons are said to have killed the sister of the informant by subjecting her to cruelty on the pretext of non-fulfillment of demand for dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against

Patna High Court CR. MISC. No.74976 of 2024(4) dt.24-01-2025 2/2 the petitioner. Petitioner is the husband of the deceased. There is no evidence on record regarding demand of dowry against the petitioner. It is further submitted that chargesheet has been submitted against the petitioner but the charge has not been framed. The petitioner has one criminal antecedent and has been rotting in judicial custody since 15.05.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Alamganj P.S. Case No.383 of 2024.
