Petitioner seeks bail in a case registered under section 379 of the Indian Penal Code.

Petitioner was earlier granted bail but he misused the privilege of bail and made absent himself from the trial proceeding as a result of which his bail bond was cancelled some time in the year 2003 and subsequently, he was arrested on 21.3.2016. Therefore, it is apparent from the aforesaid fact that the petitioner misused the privilege of bail for near about 13 years. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Chhataapur P.S. Case no. 43/2000 pending in the court of Sri Kumar Krishandeo, Judicial Magistrate, Ist Class, Supaul stands rejected, at least, at this

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of receipt/production of a copy of this order, failing which the petitioner may renew his prayer for bail before the court below itself.
